Congress, not executive, regulates prisoners

Congress has the right and the obligation to set forth policy
on how we capture and treat prisoners overseas.


U.S. Constitution, Article 1

Section 8. The Congress shall have power...

To declare war, grant letters of marque and reprisal,

and make rules concerning captures on land and water

Look, Gotham Image, we are where we are now. We didn't create these situations. Don't lie in my face and suggest that the Republicans are really the party of "original intent" (consider, for example, the notion that George Washington simply _laughed_ at, the idea that States are Sovereign).
